OSP inmate accused of murder faces federal indictment

January 31st. A federal court has indicted a prisoner accused of killing his cellmate while serving a prison sentence at the Oklahoma State Penitentiary at McAlester.

Austin Furr, 21, from Glenpool, was serving a five-year sentence in the OSP when he was accused of killing his cellmate, Dong Son, 62, in 2021.

Furr was indicted in the Eastern District of Oklahoma for second-degree murder in Indian Country.

The state charges of first-degree murder and escape from the Department of Corrections were dropped in November 2022 after a Pittsburgh County judge ruled that the state of Oklahoma did not have criminal jurisdiction over Furr because he is a Native American.

The murder affidavit states that on September 26, 2021, investigators from the Oklahoma Department of Corrections and the Office of the Inspector General were called to the OSP to report the “murder of an inmate.”

Court records show that Furr was held at the OSP following his March 2020 escape from the Jackie Brannon Correctional Center.

According to the report, investigators saw multiple lacerations and several areas of blunt trauma on Son’s body, as well as paint stains on his face.

Oklahoma Department of Corrections records show that Son was serving a life sentence without parole for the 1989 murder of an Oklahoma City business owner.

The report states that a search of the cell found numerous bloodstains, as well as a “smiley face” drawn in blood on the wall.

The affidavit states that Furr told investigators during an interview that Son attacked him with a wooden block and that he was acting in self-defense, and Furr used a “home-made sharpened tool” made of plastic to stab Son several times before than he stopped moving.

Furr told investigators that he placed Son’s body on the bottom bunk and placed a Bible next to him, and “lit and smoked a marijuana cigarette” before being ordered by a corrections officer to be placed in restraints by the door, the affidavit says.

The report states that Furr admitted to throwing paint on Son’s face during the fight and drawing a smiley face on the wall with blood after the incident happened, and flushing the makeshift weapon down the toilet.

Son’s autopsy showed the man had sustained more than 50 stab wounds, as well as “strangulation results” along with two bite marks on the man’s arm, the report said.

Court records show that charges of first-degree murder and jailbreak and/or imprisonment are currently pending in Choctaw Nation District Court.
