Mike Pence subpoenaed by special prosecutor overseeing Trump investigation: sources

Former Vice President Mike Pence has been subpoenaed by the special counsel overseeing the investigation into former President Donald Trump, several people familiar with the matter said.

Sources told ABC News that a subpoena from Special Counsel Jack Smith is seeking documents and testimony related to Trump and his allies’ failed attempt to cancel the 2020 election, culminating in the January 6 deadly attack on the U.S. Capitol.

The subpoena followed months of negotiations between federal prosecutors and Pence’s legal team.

Smith was appointed in November to oversee an investigation into Trump’s possible mishandling of classified documents after leaving the presidency and obstructing government efforts to retrieve them, as well as a separate investigation into efforts by Trump and his allies to reverse the 2020 election results. elections.

The move will be seen as a major escalation of Smith’s investigation into attempts by Trump and his allies to cancel the election and suggests that Smith’s investigation has moved into a more advanced stage.

It is not immediately clear to what extent a former vice president might attempt to invoke executive privilege over information sought by Smith, which could lead to a potentially lengthy and contentious legal battle with no clear contemporary precedent.

A spokesperson for Pence did not respond to an ABC News request for comment. The special counsel’s office declined to comment.

Trump’s spokesman also did not immediately respond.
