Man arrested on disorderly conduct charge after carrying weapon in public in East El Paso

A man who sparked a flurry of 911 calls while walking in East El Paso carrying a weapon and wearing ear protection and a vest on Nov. 10 has been arrested, the El Paso County Sheriff’s Office announced Friday.

Mario Fernando Diaz, 28, was seen walking in several El Paso neighborhoods and near the El Paso County Jail Annex carrying a weapon in an alarming manner, officials said in a news release.

As a result, numerous calls were made to 911 and schools in the immediate area were “locked down” and sheriff’s deputies headed to the Jail Annex area in an attempt to determine the man’s intentions.

On Nov. 15, a criminal warrant was obtained by the El Paso County Sheriff’s Office and Diaz was arrested on a charge of disorderly conduct, a Class B misdemeanor, and was booked into the El Paso County Jail, the news release said.

He posted the $2,000 cash bond and was released that same day, jail records show.

Officials said that while officials with the El Paso County Sheriff’s Office understand that Texas is an “open carry” state, they remind residents that they may not display a firearm or other deadly weapon in a public place in a manner calculated to alarm others.

This type of action is a crime in Texas and there is case law as current as 2019 from the Texas Court of Criminal Appeals (Texas v. Ross) that outlines the distinction, officials said.
