Little Italy woman’s son fatally shot by deputies, police sue City and County of San Diego

The son of a woman shot dead by sheriff’s deputies and police last year at the Little Italy apartment complex after she stabbed an officer has filed a wrongful death lawsuit this week alleging authorities escalated the situation while his mother was away. in a state of mental disorder. a crisis.

The lawsuit, filed Monday in federal court in San Diego, names the city of San Diego, San Diego County, and five lawyers.

Lee stabbed a police officer during the incident and was later shot dead by three deputies and a San Diego police officer.

The shooting began after MP Jason Bunch served an eviction notice at Lee’s home, and Lee opened the door with a kitchen knife by her side, authorities said.

Body camera footage released by the San Diego County Sheriff’s Department shows Bunch pointing a gun at Lee and demanding she drop the knife, while Lee repeatedly states that he doubts the deputy is a real law enforcement officer, and yelling for someone to “call the police”.

According to the lawsuit, Li’s behavior showed that she was “showing signs of mental illness” and “clearly in a state of mental crisis.” The lawsuit also says she was holding the knife because she was cooking when the deputy arrived.

Lee closed the door on Bunch and other officers responded in less than an hour.

According to the Sheriff’s Department, the condominium manager and maintenance worker told police that Lee had threatened them with a knife the day before.

“Based on this crime report, there was a threat to public safety,” the authorities said. “This is also a likely reason for Li’s arrest for assault with a deadly weapon.”

The deputies and officers then entered Li’s apartment, and while she was partially outside the bedroom door and still holding the knife, one of them shot her several times with a bag pistol.

The lawsuit alleges law enforcement officers entered the premises “under false pretenses,” at which point Lee “was in her apartment and did not pose a threat to anyone.” It also says that in addition to the rattle rounds, the authorities used stun grenades and brought in a police dog.

“Instead of using force against the deceased, the officers should have called for psychiatric help,” the complaint says.

After the non-lethal weapons were deployed, authorities said Li ran out of the bedroom to the police and deputies, who had retreated from the unit. Upon reaching the front door, Li allegedly pointed a knife at the law enforcement officers, injuring the dog training officer.

At this point, SDPD officer Rogelio Medina and the sheriff’s sergeant. Daniel Nickel and MPs Javier Medina and David Williams opened fire on Lee, firing at least a dozen bullets, and she collapsed to the floor in the hallway.

The complaint alleges that the officers and deputies used “careless tactics, including escalating a situation involving a mentally ill person, failing to develop a proper tactical plan, failing to communicate among themselves, failing to give verbal warning of the use of lethal force, and infiltrating the deceased’s unit under false pretext, when the deceased did not pose a threat to anyone and when the officers did not see how the deceased committed any crime.
