Family sues Airbnb after child dies of fentanyl overdose while renting

A family whose 19-month-old daughter died of a fentanyl overdose while staying at Airbnb while on vacation in Florida has filed a wrongful death lawsuit against the rental company and real estate landlord.

Lydie and Boris Lavenir were on holiday in Wellington, Florida with their children and found their daughter Enora in their bed just hours after arriving. The family told the Washington Post that her face was blue with white foam dripping from her lips, and that when paramedics arrived after calling 911, it was too late to save the child. According to reports from the Palm Beach County Medical Examiner and an independent toxicology report, her death was believed to have resulted from exposure to fentanyl.

It is unclear how the girl came into contact with the fentanyl in the rent, as investigators could not find any traces of fentanyl in the rented house or on her parents’ belongings. According to the Post, the investigator wrote in the latest report, “At this time, I am unable to determine how the little girl Enora Lavenir swallowed the fentanyl.”

The family’s wrongful death lawsuit lists Airbnb, property owners and a previous tenant as defendants. They allege that the rental company and the vacation home owner failed to secure the property and allege that the previous tenant was negligent in allowing drug use on the property and leaving drugs or drug residue behind.

An Airbnb spokesperson told FOX Business, “Our hearts go out to the Lavenir family and loved ones on this devastating loss.”

The previous tenant, who rented the house through Vrbo, admitted to police that he threw a party on the property where there was cocaine, but investigators were reportedly unable to link those drugs to the girl’s overdose, and his death was ruled an accident.

Fentanyl is an opioid that can be fatal in small doses and has caused thousands of deaths across the country due to a rise in overdoses in recent years. Data from the Centers for Disease Control and Prevention showed fentanyl and similar synthetic opioids were responsible for 71,238 deaths in 2021, up from 57,834 the previous year.
