Prosecutors cleared Alec Baldwin of a firearms enhancement charge in connection with a fatal shooting in October 2021 on a film set in New Mexico. Rust.

During rehearsals, a live round was fired from a fake pistol Baldwin was holding in his hands, mortally wounding cameraman Galina Hutchins and wounding director Joel Souza. Baldwin said he was told the gun was “cold” and was empty of live ammunition.

In January, Baldwin was charged with manslaughter and improving firearms, which carry a minimum prison sentence of five years. Baldwin’s lawyers argued that this version of the law was passed months after Rust shot and was incorrectly charged.

Heather Brewer, a spokeswoman for the Santa Fe County District Attorney, said in a statement Monday that firearm enhancements have been discontinued “to avoid further litigation by Mr. Baldwin and his attorneys.” The prosecution’s priority is to ensure justice, not to provide paid hours for big city prosecutors.” The amended charges were filed on Friday and also apply to Rustgunsmith Hannah Gutiérrez-Reid, who loaded the gun on the day of the shooting.

Baldwin now faces one count of manslaughter, which can carry up to 18 months in prison. The first hearing in the case is scheduled for Friday, where the judge will determine whether there are grounds for filing charges against Baldwin and Gutierrez-Reed. New York Times reports.
