A 15-year-old boy is fatally shot in the head by his older brother in the family’s Staten Island apartment.

On Tuesday, police said a 15-year-old boy who was shot in the head by his older brother at the family’s Staten Island home died the next day from his wounds.

Police officers called to an apartment on Thompson Street near Bay Street in Stapleton Heights at 11:50 pm on February 17 found Stephen Estevez on the floor with a gunshot wound to the head.

Medics took the boy to the University of Richmond Medical Center, where he died the next day.

A 17-year-old boy in the apartment, identified by police sources as Steven’s older brother, was arrested for assault and possession of a weapon.

The brother was ordered to be held without bail during a brief trial in Staten Island Criminal Court on Friday. His name is not released by the NYPD because he is a minor.

The brother is represented by the Legal Aid Society, which called the shooting “an incredibly tragic event.”

“Out of respect for our client, their family and community, we ask the public to refrain from jumping to conclusions and respect the privacy of the family during this extremely difficult time of mourning,” a spokesperson for Legal Aid said. “We will have more information about this case in the coming days, weeks and months after careful review and investigation.”

On Monday, the city medical examiner ruled Steven’s death a homicide.

The Staten Island District Attorney’s office was investigating the possibility of bringing tougher charges against the brother in light of Stephen’s death.
